General

These terms and conditions of purchase apply to sales to consumers of goods and services on xlash.com.

The service (“the website”) is provided by Beauty Generation AB, Fiskargatan 8, 116 20 Stockholm, company registration number 559150-3270 (“Xlash”, “the company”, “we” and “our”). Our terms and conditions of purchase constitute the entire agreement between the parties. No amendment to these terms and conditions of purchase is valid unless it is in writing and signed by the parties concerned. Please read the terms and conditions of purchase carefully before placing your order and print a copy for future reference. By placing an order with us or accepting delivery of one of our products, you accept these terms and conditions of purchase. Purchases on the website may be made by private individuals over 18 years of age, residing in Sweden (“the customer”, “you”, “your”).

Payment

All prices on the website are stated in SEK and include VAT. A shipping fee may apply but will then be presented before completing the order. An order is placed easily and securely on our website and becomes binding when the final step in the checkout (payment) has been completed. Shortly after your order has been completed, you will receive an order confirmation via email, which constitutes a receipt for the purchase. After the order has been completed, we unfortunately do not have the possibility to cancel the order or make changes to it.

You pay easily and securely with us via Klarna Checkout, which is offered in cooperation with our payment partner Klarna (Klarna Bank AB, Sveavägen 46, 111 34 Stockholm, company registration number 556737-0431). When paying with Klarna, a credit check may be necessary, which is carried out by Klarna, and in connection with this you may need to provide your personal identity number. Delivery

Orders placed on the website can only be delivered to addresses in Sweden. Delivery is carried out by PostNord or DHL. A delivery cost may apply, which is presented before the order is completed in the checkout. When the order is shipped from our warehouse, you will receive an email with tracking information. Our normal delivery time is 3–5 working days. We shall deliver the order without unnecessary delay, however no later than 30 days after the order has been placed, unless a delivery time of more than 30 days has been expressly agreed. If a delivery delay occurs that is of material importance to you as a customer, you have the right to cancel the agreement at no cost. If a delay occurs beyond our control, Xlash cannot be considered responsible for it and cannot be held liable for damages or compensation, unless specifically agreed between the parties or required by mandatory law.

We are responsible for your order until you have physically received it. If you can see visible transport damage to the packaging or product at the time of delivery, or if the delivery does not correspond with the information stated in your order confirmation, you are requested to notify us of this by email as soon as possible. We will then investigate the situation further and, in the event of an incorrect delivery, ensure that the correct product is sent or that the amount is refunded, depending on what is agreed and possible. Any return shipping and/or delivery cost for a new product will not be paid by the customer in this case.

If a delivery is not collected, it will automatically be returned to us. In the case of an automatic return, the customer will be refunded the entire order, including any shipping cost corresponding to the cheapest available shipping method at the time of ordering. If you have chosen a shipping method other than the cheapest offered, the difference will not be refunded. A fee of SEK 45 will be charged for return shipping and other costs associated with an automatic return. This fee will be deducted from the refunded amount.

Right of withdrawal & returns

We offer a 14-day right of withdrawal for purchases made on the website. The withdrawal period begins from the day you receive your order or, in the case of split delivery, the last part of your order. If you regret your purchase, you may within the withdrawal period either return the order or notify us in writing that you wish to exercise your right of withdrawal.

If you choose to exercise your right of withdrawal by notifying us in writing within the withdrawal period, you should email us and state that you wish to exercise your right of withdrawal. You may also choose to attach a completed withdrawal form. After your notification that you regret the purchase, you have 14 days to return the item to us. You may send the return using any shipping company and you as the customer are responsible for the return cost. In the case of a return, please email us to request a return form which you print, fill in and include in the return package.

In the case of a return, the customer is responsible for the item until we receive it. In order to receive a full refund of the amount you paid for the product(s) you return, they must be returned in unopened, sealed packaging for hygiene products. Products that are not sealed or cannot be opened due to hygiene reasons may be examined to the same extent as is normally allowed in a physical store. If you return a product that cannot be opened due to hygiene reasons with a broken seal, a deduction for diminished value may be applied. The deduction for diminished value may amount to up to 100% of the product price.

The refund is made via the same payment method used to pay for the purchase, unless otherwise specifically agreed. The refund will be made within 14 days from the date we have received your notification that you wish to exercise the right of withdrawal, provided that we have received the return or proof that the return has been sent. If you have cancelled your entire order, we will also refund the shipping cost corresponding to the cheapest available shipping method at the time of ordering, in addition to the value of the products. If you have chosen a shipping method other than the cheapest offered, the difference will not be refunded.

Please note that we cannot make any exchanges. If you wish to receive a different product, you are requested to return the ordered product and place a new order for the desired product.

A discount code can only be used for one purchase and is thereafter consumed. This also applies if you choose to cancel your purchase, in whole or in part. Your discount code will therefore not be reactivated and you will not receive a new discount code.

Right of complaint

When you shop at xlash.se you have a 3-year right of complaint. If you wish to make a complaint about a product, we ask you to contact our customer service and provide your order number and the reason for the complaint. In the event of an approved complaint, you may have the product repaired or replaced, receive a refund or a price reduction, depending on the specific situation. For a complaint to be approved, it must be justified and the defect must not have arisen as a result of incorrect use or other harmful handling. You must make the complaint within a “reasonable time” after you have discovered the defect in the product. If you make the complaint within two months after the defect was discovered, the complaint is always considered to have been made within a reasonable time.

In the event of an approved complaint, you may need to return the complained product. In such a case, we will send you a return label which you can use to send the return. When using the return label, Xlash covers the return cost. In connection with this, we will also send you a return form which we ask you to print, fill in and include in the return package

Xlash Rewards customer club

To become a member of Xlash Rewards, and thereby use the customer account, you must be at least 18 years old. If you are under 18 years old, you may only use the customer account together with your parent, guardian or legal custodian.

When you become a member of Xlash Rewards, you also give us your permission to store your name, address and phone number together with information about what you have purchased in our database. You also give us permission to contact you via email and SMS.

As a member of Xlash Rewards, you will gain access to member offers on selected products as well as collect member points that you can then use to receive products for free or at a discounted price. 1 Swedish krona spent gives 1 point.

For your purchases on www.xlash.com to be registered and thereby generate points, you must be logged into your customer account at the time of purchase. Your purchases are aggregated over one year and form the basis for your member points.

In the event of a return, your earned points will be deducted from your account. If your order included a free product, you must also return it, and you will then receive back the points you used to obtain it. If you choose to keep the product, you will be charged the full price for it.

For your purchases from any of our authorized retailers (Åhlens, Kicks, Lyko, Kronans Apotek or salon) to be registered, the valid receipt you upload must be less than one year old from the date of purchase, be clearly legible, contain the product name and price, and where you purchased the product.

In order to provide you with personalized member offers and discounts according to your preferences, we collect and process information about your purchase history and purchasing behavior with the specific purpose of creating personalized offers.

The offers you receive through your customer account may only be used by you personally and cannot be transferred to anyone else – regardless of whether they are a member or not. You may only use your offers and discounts during the time they are available via the customer account.

You may terminate your membership in Xlash Rewards at any time. This will mean that the customer account will no longer be available to you. Any achieved membership level or any offers that were available to you prior to the termination of the account will then disappear and become unavailable.

Xlash has the right to immediately terminate your membership if you breach one or more points in this agreement. Any achieved membership level or any offers that were available to you prior to the termination of the account will then disappear and become unavailable.

Privacy & use of customer information

We value your privacy when processing your personal data.
Enhanced Commerce and Cookies.
When you visit Xlash and interact with our enhanced commerce functionality, we or our third-party analytics provider collect your location and cookie-related data. We use such information to analyze the technical aspects of your use of Xlash, track your interactions with products (e.g. views, clicks, purchases), prevent fraud and abuse and to ensure Xlash security. For more information about our use of cookies, please see our Cookie Policy. The legal bases we rely on are ‘legitimate interests’ (i.e. to analyze our content and protect Xlash) and ‘your consent’. Changes to terms

Please note that local deviations may occur. We reserve the right for any typographical errors, technical errors, price changes and sold-out products. Products included in our fixed campaigns, such as “kits”, are excluded from all other offers.

We may change the terms and conditions of purchase without prior notice. Any changes apply to all orders placed after the change of our terms and conditions.

Dispute resolution

If a dispute arises between you and us, and it cannot be resolved, it shall be settled by the court determined by mandatory law. If you wish to file a case with the Swedish National Board for Consumer Disputes (ARN), you can contact them at: Allmänna reklamationsnämnden, Box 174, 101 23 Stockholm or www.arn.se. In the event of a dispute reviewed by ARN, we follow their recommendations. You may also proceed with your complaint via the EU’s common dispute resolution platform, which you can find here.
